NM FFs Charged with Rape Remain Behind Bars -- for Now

Three Albuquerque firefighters accused of raping a woman will remain behind bars -- at least for now.

District Judge Britt M. Baca-Miller ruled Thursday that Aden Heyman, Angel Portillo, and Anthony Martin will stay in jail until GPS monitors become available, KOAT reported.

Martin retired after the incident while Heyman and Portillo were suspended.

They are accused of raping a woman inside Martin's apartment on July 15.

The victim left the apartment through a bathroom window after the alleged gang rape. A resident found the victim and called police. 

State prosecutor Lisa Vigil-Roybal pushed to keep all three behind bars. 

Ben Ortega cited Martin's tenure with the fire department in an effort to get him released without a monitoring device.  

"A lifetime of service for the fire department suggests otherwise, that Mr. Martin is perfectly capable of following official directives. And so this is evidence that weighs heavily in his favor that he can abide by conditions of release," he said. 

The judge denied his request.
