The New Hampshire Supreme Court has ruled in favor of a member of the Epping Fire Department, allowing him to pursue a lawsuit against a homeowner after he fell on her icy driveway in 2008.

Firefighter Jason Antosz sustained injuries after responding to a fire at Doree Allain's home and later sued, saying it was unsafe, according to The Associated Press.

Allain argued that a state law regarding on-the-job injuries barred Antosz from suing her and a judge ruled in her favor before Friday's unanimous decision.

The court ruled that the plain language of the law allows the firefighter to pursue the claim.

The case will now be sent back to superior court.
